StayStat Terms of Service

Acceptance of Terms

By downloading, installing, or using the StayStat mobile application, you agree to be bound by these Terms of Service.
If you do not agree to these terms, please do not use our application.
We reserve the right to modify these terms at any time with notice to users.

Mobile Application: StayStat is an iOS mobile application for tracking travel and immigration status.
Core Features: The app helps users monitor country changes through location services, manage visa requirements, and view local travel analytics.
Local Processing: All personal data processing occurs locally on your device using Core Data and Keychain storage.
Optional Services: Crash reporting through Firebase Crashlytics (requires user consent and can be disabled).

Accurate Information: Users are responsible for providing accurate travel and immigration information when manually entering data.
Legal Compliance: Users must comply with all local laws and immigration requirements. The app provides information but not legal advice.
Device Security: Users are responsible for securing their device, enabling device passcode/biometric locks, and protecting app data.
Permission Management: Users can revoke location permissions or disable crash reporting at any time through iOS settings or in-app privacy controls.
Prohibited Uses: Users may not use the app for illegal activities or to circumvent immigration laws.

Personal Use Only: The app is licensed for personal, non-commercial use only.
No Reverse Engineering: Users may not reverse engineer, decompile, or disassemble the app.
No Unauthorized Access: Users may not attempt to access unauthorized features or data.
Intellectual Property: All app content and trademarks belong to StayStat.

Information Accuracy: We strive for accuracy but cannot guarantee all travel information is current or complete.
Immigration Advice: This app does not provide legal or immigration advice.
Service Availability: We do not guarantee uninterrupted service availability.
User Decisions: Users are solely responsible for their travel and immigration decisions.

StayStat and its developers shall not be liable for any indirect, incidental, special, or consequential damages.
Our total liability shall not exceed the amount paid by the user for the app (if any).
This limitation applies to all claims, whether based on warranty, contract, tort, or any other legal theory.

Privacy Policy: Your privacy is protected as described in our comprehensive Mobile App Privacy Policy.
Local Processing: All personal travel data is processed locally on your device using encrypted Core Data and Keychain storage.
Optional Data Collection: Only anonymous crash reports (with consent) and location data (when granted) may be collected as described in our privacy policy.
Compliance: We comply with applicable data protection laws including GDPR, CCPA, and iOS App Store privacy requirements.

You may terminate your use of the app at any time by deleting it from your device.
We may terminate or suspend access to our app immediately for violations of these terms.
Upon termination, all data stored locally on your device will remain under your control.

Your Data Ownership: You retain full ownership of all data you create within the StayStat app (travel entries, expenses, notes, preferences).
Local Storage: Personal data is stored on your device using Core Data protected by iOS Data Protection (FileProtectionType.completeUnlessOpen — selected so CloudKit can continue syncing while the device is locked) and iOS Keychain for sensitive values.
Apple iCloud Sync (Optional): Travel data can sync across your signed-in Apple devices through your own Apple iCloud account (CloudKit). StayStat does not store or have access to your data on any StayStat or third-party servers, and you can disable iCloud sync anytime in iOS Settings.
Backup Responsibility: You are responsible for backing up your device through iCloud or Finder/iTunes backups.
Data Recovery: If you delete the app on all your devices and disable iCloud before backing up, we cannot recover your data.
Export Functionality: Use the in-app export features (PDF, CSV, IRCC-compliant report) to create your own backups of travel data.

App Ownership: StayStat, including its code, design, trademarks, and logos, is owned by StayStat.
Limited License: You are granted a non-exclusive, non-transferable license to use the app for personal purposes.
Restrictions: You may not copy, modify, distribute, sell, or reverse engineer any part of the app.
User-Generated Content: You retain ownership of data you create, but grant us a license to process it for app functionality.
Third-Party Materials: The app may use third-party libraries and APIs, each subject to their respective licenses.
Trademark Notice: "StayStat" and the StayStat logo are trademarks. Unauthorized use is prohibited.

As-Is Basis: The app is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.
No Guarantees: We do not warrant that the app will be error-free, uninterrupted, or meet your specific requirements.
Accuracy: While we strive for accuracy, we do not guarantee the completeness or accuracy of travel information.
Third-Party Data: Visa requirements and travel rules are provided for informational purposes and may not be current.
Use at Your Own Risk: You acknowledge that you use the app at your own risk and discretion.

You agree to indemnify and hold harmless StayStat and its developer from any claims, damages, or expenses arising from:
Your use or misuse of the app
Your violation of these Terms of Service
Your violation of any third-party rights, including intellectual property or privacy rights
Any illegal activities conducted using the app

Excused Performance: We are not liable for delays or failures due to circumstances beyond our reasonable control.
Covered Events: Natural disasters, acts of government, labor disputes, internet outages, third-party service failures (Firebase, Apple services).
Notification: We will make reasonable efforts to notify users of significant service disruptions when possible.

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force.
Invalid provisions will be modified to the minimum extent necessary to make them enforceable while preserving intent.
The failure to enforce any right or provision does not constitute a waiver of that right or provision.

These Terms of Service, together with our Privacy Policy and GDPR Compliance page, constitute the entire agreement between you and StayStat.
These terms supersede any prior agreements or understandings, whether written or oral.
Any amendments to these terms must be in writing and posted to this page with an updated "Last Updated" date.

Jurisdiction: These terms are governed by the laws of Canada and the Province of Quebec.
Dispute Resolution: Any disputes will be resolved in the courts of Montreal, Quebec, Canada.
Language: In case of discrepancies between translations, the English version of these terms shall prevail.
Severability: If any provision is found unenforceable, the remaining provisions will remain in effect.
